\nVISTA la legge 23 agosto 1988, n. 400, recante “Disciplina dell’attività di Governo e ordinamento della Presidenza del Consiglio dei ministri”;
\nVISTO il decreto legislativo 30 luglio 1999, n. 303, recante “Ordinamento della Presidenza del Consiglio dei ministri, a norma dell'articolo 11 della legge 15 marzo 1997, n. 59”;
\nVISTO il decreto legislativo 2 gennaio 2018, n. 1, e successive modifiche e integrazioni, recante “Codice della protezione civile”, ed in particolare gli articoli 15 e 17;
\nVISTA la direttiva del Presidente del Consiglio dei ministri del 6 aprile 2006 concernente il “Coordinamento delle iniziative e delle misure finalizzate a disciplinare gli interventi di soccorso e di assistenza alla popolazione in occasione d’incidenti stradali, ferroviari, aerei e in mare, di esplosioni e crolli di strutture e d’incidenti con presenza di sostanze pericolose”;
\nVISTA la direttiva del Presidente del Consiglio dei ministri del 30 aprile 2021 concernente “Indirizzi per la predisposizione dei piani di protezione civile ai diversi livelli territoriali”;
\nVISTO l’articolo 21 del decreto legislativo 26 giugno 2015, n. 105 recante “Attuazione della direttiva 2012/18/UE relativa al controllo del pericolo di incidenti rilevanti connessi con sostanze pericolose”, che prevede, al comma 7, che il Dipartimento della protezione civile stabilisca, d'intesa con la Conferenza Unificata, le linee guida per la predisposizione del piano di emergenza esterna, e per la relativa informazione alla popolazione e, al comma 8, che sulla base delle proposte formulate dal Coordinamento per l'uniforme applicazione sul territorio nazionale, di cui all'articolo 11, comma 1, del medesimo decreto, d'intesa con la Conferenza Unificata, si provveda all'aggiornamento delle linee guida di cui al citato comma 7;
\nVISTO il decreto del Presidente del Consiglio dei ministri 25 febbraio 2005 “Linee guida per la predisposizione del piano d’emergenza esterna di cui all’art.20 comma 4 del decreto legislativo n. 334”;
\nVISTO il decreto del Presidente del Consiglio dei ministri 16 febbraio 2007 “Linee guida per l'informazione alla popolazione sul rischio industriale”;
\nCONSIDERATO che, ai sensi dell’articolo 15 del decreto legislativo 2 gennaio 2018, n. 1, su proposta del Capo del Dipartimento della protezione civile, possono essere adottate direttive del Presidente del Consiglio dei ministri al fine di assicurare, sul piano tecnico, l’indirizzo unitario, nel rispetto delle peculiarità dei territori, per l’esercizio della funzione e lo svolgimento delle attività di protezione civile, nell’ambito dei limiti e delle finalità delle quali, il Capo del Dipartimento della protezione civile, può adottare indicazioni operative volte all’attuazione di specifiche disposizioni in esse contenute da parte del Servizio nazionale della protezione civile, consultando preventivamente le componenti e le strutture operative nazionali interessate;
\nVISTO il decreto del Capo del Dipartimento della protezione civile repertorio n. 691 del 16 febbraio 2018 che demanda ad un gruppo di lavoro inter-istituzionale la redazione delle linee guida di cui alla presente direttiva composto da rappresentanti del Dipartimento della protezione civile della Presidenza del Consiglio dei ministri, del Ministero dell’ambiente e della tutela del territorio e del mare, del Ministero dell’interno, dell’ISPRA, dell’ANCI, dell’Istituto Superiore di Sanità, dell’ARPA Toscana, della Regione Marche, dell’ARPA Abruzzo, dell’ARPA Emilia-Romagna, dell’ARPA Piemonte, della Regione Piemonte e dell’INAIL;
\nVISTO il decreto del Capo del Dipartimento della protezione civile repertorio n. 2495 del 19 luglio 2019 con il quale le attività del suddetto Gruppo di lavoro sono state prorogate fino al 16 febbraio 2020;
\nVISTO il decreto del Presidente del Consiglio dei ministri in data 10 novembre 2022, con il quale al Ministro senza portafoglio senatore Sebastiano Musumeci, detto Nello, è stato conferito l’incarico per la protezione civile e le politiche del mare;
\nVISTO il decreto del Presidente del Consiglio dei ministri in data 12 novembre 2022, con il quale sono state delegate al Ministro senza portafoglio senatore Sebastiano Musumeci, detto Nello, le funzioni del Presidente del Consiglio dei ministri ivi indicate, con particolare riferimento all’articolo 2 concernente la delega di funzioni in materia di protezione civile;
\nRAVVISATA la necessità di armonizzare le attività riguardanti la pianificazione di emergenza esterna, la relativa informazione alla popolazione, unitamente ai criteri di sperimentazione dei piani di emergenza esterna con i principi della richiamata direttiva 2012/18/UE;
\nACQUISITA l’intesa della Conferenza unificata di cui all’articolo 8 del decreto legislativo 28 agosto 1997, n. 281, espressa nella seduta del 30 novembre 2022;
\nSU PROPOSTA del Capo del Dipartimento della protezione civile della Presidenza del Consiglio dei ministri;
